Main issues, as the Inspector framed them

  • whether the condition in dispute is reasonable and necessary in the interests of protecting the character and appearance of the area, including the Green Belt and Ancient Arden Landscape
  • whether the condition in dispute is reasonable and necessary in the interests of protecting the living conditions of occupiers of adjacent properties
  • the effect of the appeal development on biodiversity

What decided it

The development would not comply with the mandatory Biodiversity Net Gain requirements under Schedule 7A of the Town and Country Planning Act 1990, as the self-build exemption mechanism in the original condition cannot be reliably enforced.

Although the disputed condition was found to be unreasonable and unnecessary for protecting character, appearance and living conditions, the conflict with mandatory biodiversity net gain requirements and statutory provisions outweighed any other considerations, resulting in dismissal.
