Main issues, as the Inspector framed them

  • the effect of the development upon the living conditions of the residents of Ashford House Residential Care Home, with specific regard to noise and disturbance
  • whether the proposed development would be secured as a self-build development, and its implications for BNG

What decided it

The failure to secure the development as a self-build dwelling through a binding legal mechanism meant the mandatory 10% biodiversity net gain requirement applied and had not been demonstrated to be met, which the Inspector found could not be outweighed by the benefit of one additional dwelling.

Applying Policy S4, the benefit of one additional dwelling within the settlement, to which substantial weight should be afforded under Policy L2, did not carry substantial weight that would outweigh the mandatory national requirement for biodiversity net gain which had not been fulfilled, thereby weighing against the development.
