Main issues, as the Inspector framed them
- whether the appeal site would be a suitable location for the proposed development having regard to the Breckland Local Plan (2023)
- the effect of the proposed development on the character and appearance of the area
- the effect of the proposed development on habitats sites
What decided it
The absence of a secured planning obligation to fund habitats mitigation meant the proposal could not be assessed as having no adverse effect on the integrity of designated habitats sites, triggering a mandatory refusal under Framework Policy N6.
The substantial weight attributed to the benefit of one new dwelling towards the housing shortfall was substantially outweighed by the adverse effects of harm to character and appearance and the inability to rule out significant harm to habitats sites integrity, when assessed against Framework Policies N6 and DP3.
