Main issues, as the Inspector framed them

  • The effect of the proposed development on the living conditions of the occupants of 10 Nutshell Lane in relation to outlook and light on a cumulative basis

What decided it

The Daylight and Sunlight Analysis using established BRE benchmarks demonstrated that the amenity space retained approximately 93% sunlight in summer months and all assessed windows met BRE guideline values, such that the cumulative effects of outlook and light loss were not sufficient to warrant refusal.

The weighty benefits of granting permission for additional floorspace within the settlement were not substantially outweighed by any adverse effects on the living conditions of neighbouring occupants when assessed against NPPF policy S4(1)
