Main issues, as the Inspector framed them

  • whether the proposed development would be appropriately located, having particular regard to the viability and vitality of the town centre
  • the effect of the proposed development upon the character and appearance of the property with particular regard to whether the development would preserve or enhance the character or appearance of the Great Weston Conservation Area

What decided it

The harm to the significance of the Great Weston Conservation Area caused by the loss of the retail unit and the poor quality of the proposed front elevation, which would not be outweighed by the limited public benefits of the proposal.

applying Policy S4, the benefits of the proposal, including improved dwelling access, housing mix contribution, removal of roller shuttering and minor additional footfall, would be substantially outweighed by the adverse effects of the loss of retail use from a location wholly appropriate for continued commercial use and the harmful effect upon the character and appearance of the conservation area, such that the presumption in favour of sustainable development does not apply
