Main issues, as the Inspector framed them

  • whether or not the site is a suitable location for the proposed development, having regard to the development plan
  • whether or not the proposed development would meet the sequential and exception test as appropriate, which seek to steer new development away from areas at the highest risk of flooding
  • the effect of the proposed development on the character and appearance of the area

What decided it

The failure to demonstrate an essential functional need for a rural worker's dwelling, combined with the proposal's failure to satisfy the sequential flood risk test and resulting harm to character and appearance, meant the adverse effects substantially outweighed the modest benefits under the Framework's Policy S5 balance.

The modest benefits of housing delivery, construction employment, and private benefit to the appellant were substantially outweighed by the adverse effects of locational unsuitability, failure of the sequential flood risk test, and harm to character and appearance when assessed against the Framework's national decision-making policies.
