Main issues, as the Inspector framed them

  • the effect of the proposed development on the supply of family housing in the Borough
  • whether the proposed development would accord with the Council's strategy for delivering specialist accommodation, having regard to relevant development plan policies for specialist accommodation needs
  • whether the development would make adequate provision for sustainable travel

What decided it

The existence of a lawful development certificate for the same site as a C3(b) care home, which would similarly remove a family-sized dwelling from the market, meant the appeal scheme would result in no greater harm than the fallback position, attracting substantial weight in the overall assessment.

The loss of a family-sized dwelling, which would result in harm to the supply of family housing, was outweighed by the provision of specialist accommodation meeting identified needs for children with complex needs and the substantial weight of the fallback position, which would cause equivalent harm to family housing supply.
