Main issues, as the Inspector framed them

  • whether the proposal would provide safe and suitable access
  • whether the proposal would achieve biodiversity net gain, having regard to whether any exemptions apply

What decided it

The failure to demonstrate that biodiversity net gain would be achieved, combined with the statutory footing of the BNG requirement, substantially outweighed the benefits of housing provision.

The substantial weight given to the provision of a dwelling within a settlement in the light of a housing supply of approximately 2.8 years was substantially outweighed by the harm resulting from the failure to meet the statutory biodiversity objective.
