Main issues, as the Inspector framed them

  • The effect of the proposal on the character and appearance of the surrounding area
  • The effect of the proposed development on the living conditions of the occupiers of No. 55 Orchard Lane with regards to outlook
  • The effect of the proposal on biodiversity

What decided it

The proposal would fail to respond to its context and would not integrate with its surroundings, conflicting with Policy DP3 of the Framework, and this substantial harm to character and appearance substantially outweighed the benefits of housing delivery in a context of 3.3 years' supply.

Applying Policy S4, the benefits of the proposal—substantial weight for housing delivery where the Council has 3.3 years' supply, and limited weight for economic benefits and sustainable location—were substantially outweighed by the substantial weight attached to the conflict with Policy DP3 and the adverse effects on character and appearance, and therefore the proposal should not be approved.
