Main issues, as the Inspector framed them

  • whether the proposed ground floor bedrooms would be safe from flooding
  • whether the proposed development would provide acceptable living conditions for future occupiers, with regard to the provision of kitchen, dining and bathroom facilities

What decided it

The proposed ground floor bedrooms would not be safe from flooding and the development would not be appropriately flood resistant in accordance with Framework Policy F7, which states development in flood zones should be refused unless certain criteria are met.

Framework Policy S4 requires development proposals within settlements to be approved unless the benefits would be substantially outweighed by any adverse effects; the benefits of effective use of land, including social and economic benefits, were substantially outweighed by the adverse effects of inadequate flood protection, therefore Framework Policy S4 weighed against granting permission
