Main issues, as the Inspector framed them

  • whether the proposal would provide acceptable living conditions for future occupiers, with regard to the provision of external amenity space and outlook
  • whether the proposal would achieve a suitable standard of fire safety

What decided it

The proposal would conflict with the explicit design standard in Policy D6 of the London Plan concerning the provision of private outside space, and no clear justification had been demonstrated for that conflict, such that Policy DP3 of the Framework indicated refusal, and the benefits of the proposal would be substantially outweighed by its adverse effects when assessed against the national decision-making policies of the Framework.

Although the proposal would provide one additional dwelling with modest social and economic benefits (to which moderate weight was attached), these benefits would be substantially outweighed by the conflict with Policy DP3 of the Framework and the failure to provide acceptable living conditions for future occupiers in terms of external amenity space and outlook.
