Main issues, as the Inspector framed them

  • the effect of the proposal on the Chesil Beach and the Fleet European Designated Sites
  • whether the proposal would provide safe accommodation for its intended use and lifetime, having regard to flood risk

What decided it

The requirements of the Habitats Regulations were not satisfied because no planning obligation or other mechanism was in place to secure the necessary mitigation contribution to address the proposal's in-combination recreational effect on the Chesil Beach and the Fleet European designated sites.

Applying Policies S3 and S4, the substantial weight given to the benefits of providing four supported-accommodation rooms and modest socio-economic benefits was outweighed by the failure to satisfy the Habitats Regulations, which required that an appropriate assessment conclude the proposal would not adversely affect the integrity of the designated sites; this requirement was determinative and prevented permission being granted.
