What decided it
The inability to be certain beyond all reasonable scientific doubt that the proposal would not have an adverse impact on the integrity of the Solent and Southampton Water SPA through the discharge of additional nutrients from wastewater, as no adequate mechanism or mitigation was secured.
The tilted balance under paragraph 11(d) of the Framework was engaged due to the Council's inability to demonstrate a 5-year housing land supply, but the clear reason for refusal provided by the likely adverse effect on the SPA's integrity, a policy protecting an asset of particular importance, outweighed the housing supply benefits.
