Main issues, as the Inspector framed them
- whether the location of the development is appropriate having regard to the development plan
- the effect of the development on the character and appearance of the area, having regard to its location within the Isle of Wight Area of Outstanding Natural Beauty (AONB)
- the effect of the development on the Solent Special Protection Area (SPA)
What decided it
The site's location within the AONB and the requirement under paragraph 176 of the Framework to conserve and enhance its landscape and scenic beauty provides a clear reason for refusal that displaces the presumption in favour of sustainable development despite the Council's housing land supply shortfall.
Although the Council lacks a five-year housing land supply, the protection afforded to the AONB as an area of particular importance under paragraph 11(d)(i) of the Framework provides a clear reason for refusal that outweighs the presumption in favour of sustainable development.
