What decided it

The fallback position of the Certificate of Lawful Development for an identical structure, combined with the ancillary nature of the proposed use and the absence of harmful effects on character and appearance, justified allowing the appeal.

The modest size and design of the outbuilding, its consistency with other structures in the area, and the material fallback position of the lawful development certificate outweighed the technical breach of Policy DMHD 2 criterion iv regarding the bathroom, particularly given the ancillary nature of the use and the protective condition imposed.
