Main issues, as the Inspector framed them
- Whether the buildings benefit from permitted development rights under Class E of the Town and Country Planning (General Permitted Development) (England) Order 2015
- Whether the buildings are provided within the curtilage of the dwellinghouse
- Whether the buildings are required for a purpose incidental to the enjoyment of the dwellinghouse
- Whether Building B is inappropriate development in the Green Belt
- The effect of Building B on the openness of the Green Belt
- The effect of Building B on the character and appearance of the area
- Whether very special circumstances exist to justify Building B as inappropriate development
What decided it
Building B was located outside the curtilage of the dwellinghouse as it was mostly constructed on land to the north of the former white painted wall which formed a substantial physical boundary, and therefore did not benefit from Class E permitted development rights and constituted a breach of planning control that could not be justified.
