What decided it
Appeal A was dismissed because the mitigating access and parking scheme relied upon to resolve the highway safety harm fell outside the land covered by the enforcement notice and outside the appellant's control, whereas Appeal B was allowed because that same access and parking scheme was within the application site and was found to overcome the highway safety harm.
In Appeal A, the harm to highway safety outweighed the benefits of biodiversity improvements and outweighed the demonstrated essential need and absence of character harm, leading to dismissal; in Appeal B, no harm to highway safety or character/appearance was found and the essential need test was met, so the proposal accorded with the development plan and was allowed.
