What decided it

The fence creates a harmful overbearing effect on the living conditions of occupiers of adjacent Staple Gardens properties by reason of its height, length and solidity, resulting in a gloomy oppressive outlook, which conflicts with Policy DM17(vii) and cannot be outweighed by the limited privacy and other benefits offered.

The privacy benefits of the fence and the benefit of revised flue arrangements were given little and limited weight respectively, but were substantially outweighed by the significant harm to the living conditions of neighbouring occupiers through the overbearing effect and loss of outlook, resulting in conflict with the development plan.
