Main issues, as the Inspector framed them

• whether the appeal site is a suitable location for the proposed development, having regard to local and national policies
• the effect on the living conditions of the occupants of the site as a result of noise disturbance
• the effect of the proposal on the character and appearance of the area and whether it would conserve and enhance the landscape and scenic beauty of the North Wessex Downs AONB
• whether there are material considerations which exist that outweigh the conflicts with the Development Plan and any other identified harm resulting from the appeal proposal

What decided it

The lack of any suitable alternative site for the appellant's family, combined with the pressing personal circumstances and best interests of the children, clearly outweighed the identified harms.

the modest/moderate harm to the AONB's character and appearance, the sustainability shortfall and the harm from intentional unauthorised development were clearly outweighed by the unmet gypsy and traveller need, the lack of suitable alternative sites, and the personal circumstances and best interests of the children
