The proposal would result in significant harmful effect on the integrity of the Blackwater Estuary SPA and the Crouch and Roach Estuaries SPA and Ramsar sites without secured mitigation, providing a clear reason for refusal that disengages the presumption in favour of sustainable development under Framework paragraph 11.
The moderate weight afforded to the contribution to housing supply in a sustainable location and substantial weight to the use of previously developed land were outweighed by the very substantial weight given to the conflict with design policies and the Framework's requirement for high quality, beautiful and sustainable buildings, combined with the very substantial weight given to the unmitigated harm to habitats sites integrity.
