Main issues, as the Inspector framed them
- whether there is an essential need for the development for the effective operation of Grist Farm
- the effect of the development on the Chichester and Langstone Harbours Special Protection Area (SPA)
What decided it
The evidence relating to the availability of alternative accommodation and the financial soundness and future viability of the enterprise was insufficient to demonstrate compliance with Policy H9 and Appendix C requirements.
The need to remedy the breach of planning control and protect the character and appearance of the countryside outweighed the interference with the occupiers' right to respect for private and family life, which was justified as necessary and proportionate given the 12-month compliance period.
