What decided it

The Council's refusal was based solely on the absence of personal evidence of Gypsy and Traveller status and need, without weighing this against the acknowledged general need and the availability of an occupancy condition, and without identifying any tangible site-specific harm.

The Council failed to weigh the benefits of the Gypsy and Traveller accommodation (supported by an acknowledged general need and securable by condition) against any identified harm, which the Inspector found amounted to unreasonable behaviour warranting a partial costs award.
