Main issues, as the Inspector framed them

  • Whether a Habitats Regulations compliant appropriate assessment can be concluded and, if so, on what basis.
  • Whether the evidence otherwise indicates that the reserved matters should be approved.

What decided it

The imposition of a Grampian-style condition (Condition 6) securing water neutrality mitigation via SNOWS or an equivalent scheme enabled a favourable Habitats Regulations appropriate assessment to be concluded.

The significant benefits of housing, affordable housing, employment, economic benefits, open space, landfill remediation and biodiversity, combined with accordance with the Outline Permission and development plan, outweighed the need for further restriction, once conditions ensured no adverse effect on the integrity of the Arun Valley Sites.
