What decided it

The lack of clear evidence that the proposed noise mitigation measures could be fully implemented, particularly the substantial structural alterations required to the separating floor and uncertainty about the ability to alter the leased ground floor premises, meant the Inspector could not determine with certainty that noise from the public house would be successfully managed in breach of MA.2(2)(d) of the GPDO.
