The appellant failed to demonstrate an essential need for a permanent (as opposed to seasonal) on-site presence and failed to provide robust evidence of the enterprise's economic viability, resulting in conflict with Policy DM28 that was not outweighed by other considerations.
The identified adverse impacts of the proposal, principally conflict with Policy DM28, significantly and demonstrably outweighed the modest social, economic and environmental benefits and the small benefit of an additional home, so the presumption in favour of sustainable development did not apply and the appeal was dismissed.
