Main issues, as the Inspector framed them

  • Whether the requirement for a footway from the site to a bus stop, imposed as condition 10, would be necessary and reasonable in respect of access and highway safety

What decided it

The provision of the footway would be disproportionate to the size of a single dwelling and therefore unreasonable, particularly given the absence of recorded pedestrian injury collisions and the minimal additional pedestrian traffic the development would generate.

The Inspector balanced the policy encouragement for sustainable travel and pedestrian safety against the requirement that conditions be proportionate and reasonable; the proportionality and reasonableness test outweighed the sustainability objective in this case.
