Main issues, as the Inspector framed them

  • Whether the breach of planning control alleged in the enforcement notice — material change of use from a residential dwelling to short-term letting residential property — has occurred as a matter of fact (ground (b) appeal)

What decided it

The evidence of online listings and booking records plainly demonstrated that the property had been used for short-term let accommodation by the date of the enforcement notice, and the number of nights of such use in 2023 exceeded the ninety-day threshold in section 25A of the Greater London (General Powers) Act 1973.
