What decided it
The Inspector could not be certain that the development would not result in likely significant effects upon the Thames Basin Heaths Special Protection Area due to an inadequate SAMM contribution in the Unilateral Undertaking, which under Regulation 63(5) of the Conservation of Habitats and Species Regulations 2017 precluded the development from proceeding.
The limited weight given to housing supply contribution and small economic and drainage benefits was substantially outweighed by very significant weight against the scheme due to inability to secure adequate SPA mitigation, significant weight against the scheme due to harm to character and appearance, and moderate weight against the scheme due to inadequate daylight provision for future occupiers.
