Main issues, as the Inspector framed them

  • Whether the enforcement notice was properly served on all persons with an interest in the land (ground (e))
  • Whether the matters comprising the alleged breach of planning control have occurred (ground (b))
  • Whether the compliance period specified in the notice falls short of what should reasonably be allowed (ground (g))

What decided it

The highway safety risks arising from the use of the site as a four-pitch traveller site on New Haw Road, balanced against the personal circumstances of the occupiers and the best interests of the children, justified a twelve-month compliance period for most requirements and fifteen months for hardstanding removal.

The absence of suitable alternative pitches, the stability provided by the site for children's education and medical appointments, and the occupiers' Article 8 rights and protected characteristic as ethnic minorities were weighed against the highway safety risks and the need to bring the unauthorised development to an end in the public interest, resulting in a varied compliance period of twelve to fifteen months.
