What decided it
The failure to secure the dwellings as self-build units through a binding legal mechanism meant the statutory biodiversity gain exemption could not be relied upon, and the proposal could not demonstrate compliance with the mandatory 10% biodiversity gain requirement, which carried substantial weight against the housing benefits.
The benefits of housing supply and efficient use of land were countered by the substantial weight of the conflict with biodiversity gain requirements and Schedule 7A of the Town and Country Planning Act 1990, such that adverse impacts significantly and demonstrably outweighed benefits under paragraph 11(d) of the Framework.
