What decided it

The previous appeal decision did not take a determinative view on spatial housing policies, leaving the matter open for the Council to raise in its subsequent decision, and the Council was entitled to weigh the benefits of self-build housing against the modest conflict with the development plan.

Material considerations associated with self-build housing delivery and the absence of a five-year housing supply, in combination, were found to be of overriding weight which outweighed the modest conflict found with the development plan, but these matters did not clearly demonstrate material considerations of overriding importance such that the Council acted unreasonably in refusing the scheme.
