The failure to provide a competent Preliminary Ecological Appraisal to demonstrate that the proposal would not adversely affect European protected species, particularly Great Crested Newts, meant the adverse impacts to biodiversity significantly and demonstrably outweighed the housing benefits.

The housing supply benefits and positive contribution to meeting housing requirements were outweighed by the significant harm to biodiversity and conflict with Core Policy CP9 and Framework environmental policies, such that the presumption in favour of sustainable development did not apply.
