Main issues, as the Inspector framed them

  • whether the proposal would be inappropriate development in the Green Belt, having regard to the National Planning Policy Framework and any development plan policies, including any relevant effects on the openness of the Green Belt
  • if inappropriate, whether any harm by reason of inappropriateness would be clearly outweighed by other considerations so as to amount to the very special circumstances required to justify the proposal
  • the effect of the development upon protected and priority species
  • the effect of the development upon trees and hedgerows

What decided it

The defective and incomplete Unilateral Undertaking prevented the proposal from complying with the Golden Rules in NPPF paragraph 156, meaning the development could not benefit from the exception in paragraph 155(d), and the substantial harm to the Green Belt by reason of inappropriateness was not clearly outweighed by other considerations.

The moderate weight benefits of housing delivery and economic gains would not clearly outweigh the substantial harm to the Green Belt by reason of inappropriateness, so very special circumstances do not exist.
