What decided it
The Council's failure to meet its statutory duty under the Self-build and Custom Housebuilding Act 2015 to grant development permission for enough serviced plots to meet demand, combined with the Framework's support for self-build and custom build housing, outweighed the less than substantial harm to the conservation area and conflict with the spatial strategy.
The less than substantial harm to the significance of Donington-le-Heath Conservation Area, loss of best and most versatile agricultural land, and conflict with the spatial strategy were outweighed by the great weight given to meeting the Council's statutory duty to provide serviced plots for self-build housing and the benefits of boosting housing supply.
