Main issues, as the Inspector framed them
- Whether the appeal site is a suitable location for the proposed development with regard to relevant policies relating to development in the countryside
- Whether the appeal site is a suitable location with regard to flood risk
What decided it
The site's location in the countryside with poor pedestrian accessibility and significant flood risk preventing safe access and egress, combined with the appellant's failure to demonstrate compliance with NPPF Paragraph 84 criteria, means the proposal is not sustainable development even under the tilted balance.
The presumption in favour of sustainable development under Paragraph 11 was displaced by the application of Framework policies protecting areas at risk of flooding, which provide a strong reason for refusing the development; the housing land supply shortfall did not outweigh the flood risk and countryside location concerns
