What decided it
The proposal accords with the development plan taken as a whole, preserving the conservation area and not harmfully affecting neighbouring living conditions, such that the shortfall in housing land supply does not require application of the tilted balance to override the development plan.
Although the Council cannot demonstrate five years' housing land supply, the proposal accords with the development plan and does not provide a strong reason for refusal under paragraph 11(d) of the Framework, as it would preserve the conservation area and not harm the scenic beauty of the East Devon National Landscape; accordingly, the presumption in favour of sustainable development does not alter the outcome.
