Main issues, as the Inspector framed them

  • whether the appeal proposal is an appropriate location for an unrestricted residential dwelling, having regard to the spatial policies of the development plan

What decided it

The appeal property qualifies as previously developed land within the scope of policy S5 of the Framework, and the benefits of providing one additional dwelling are not substantially outweighed by adverse effects, particularly given the change of use nature means a genuine choice of transport modes would be impractical.

The material increase in car-borne trips and carbon emissions conflicting with the development plan was outweighed by the Framework as a material consideration of critical importance, which permitted the development as previously developed land under policy S5 where benefits were not substantially outweighed by adverse effects.
