Main issues, as the Inspector framed them

  • Whether the proposal would be inappropriate development in the Green Belt having regard to the Framework
  • The effect of the proposal on flood risk
  • The effect of the proposal on the character and appearance of the area
  • The effect of the proposal on highway safety
  • Whether adequate information has been provided with regard to biodiversity net gain

What decided it

The proposal is located in Flood Zone 3b where Policy F6 of the Framework directs that more vulnerable development (dwellinghouses) should be refused, and the appellant failed to undertake a sequential test or provide adequate evidence that flood risk would not be significant.

Applying Policy S5, the substantial benefits of providing 8 new homes against a 3.43-year housing supply shortfall, together with moderate benefits of visual improvement and biodiversity net gain and limited benefits from contamination removal, are substantially outweighed by the adverse effects of locating more vulnerable residential development in Flood Zone 3b in conflict with Policy F6 and the development plan's flood risk policies.
