Main issues, as the Inspector framed them

  • The effect of the felling of a protected tree upon the character and appearance of the area, having particular regard to whether it would preserve or enhance the character or appearance of the conservation area, and preserve the settings of listed buildings and any features of special architectural or historic interest they possess

What decided it

The magnolia makes a positive contribution to the conservation area and listed building settings, felling would cause considerable harm, and it has not been conclusively demonstrated that felling is the only means of preserving the boundary wall.

The considerable harm to the conservation area and to the setting of Glenthorne House, and the uncertainty whether felling is necessary, weigh heavily against the scheme; although there would be important public benefits from the wall, railings and piers and the change of use to residential, they would not outweigh the substantial harms to the designated heritage assets.
