Main issues, as the Inspector framed them

  • The effect of the proposed opening hours on the living conditions of neighbours, with regard to noise and disturbance

What decided it

The Noise Impact Assessment, supported by the Council's Pollution Control Officer, demonstrated that with implementation of recommended mitigation measures and the Operational Management Plan, the proposed 24-hour operation would not result in unacceptable noise and disturbance to neighbouring occupiers.

The benefits of bringing a vacant unit back into use with employment and footfall generation, supported by robust evidence of no unacceptable noise impacts with mitigation, outweighed concerns about loss of retail use (mitigated by 18+ months of unsuccessful marketing) and the absence of comparable 24-hour premises in the immediate area.
