Main issues, as the Inspector framed them

  • the effect of the proposal upon the living conditions of neighbouring occupiers, with particular regard to noise and disturbance

What decided it

The Noise Impact Assessment's failure to assess internal noise generation within the takeaway premises and its transmission to the residential accommodation above, combined with the reasonable expectation of elevated customer noise during extended late-night hours, meant the proposal would not adequately safeguard residential amenity.
