Main issues, as the Inspector framed them

  • The effect of the proposal on the living conditions of neighbouring occupiers at 25 - 33 Garway Road, with particular regard to noise and odour

What decided it

The proposal's siting within the lightwell would cause unacceptable noise and odour impacts to neighbouring residents at 25 – 33 Garway Road that could not be adequately mitigated by conditions or alternative mitigation measures.

Applying Policy S4, the benefits of approving the proposal in terms of extraction provision for the existing café are substantially outweighed by adverse effects in respect of healthy living conditions and avoiding exposure to unacceptable levels of air and noise pollution, when assessed against the national decision-making policies in the Framework.
