Main issues, as the Inspector framed them

  • Whether the proposed development would provide acceptable living conditions for future occupiers
  • Whether the proposal would provide a safe and acceptable living environment having regard to flood risk
  • Whether satisfactory refuse, recycling and cycle storage facilities would be provided, having regard to their accessibility, practicality and effect on the character and appearance of the conservation area

What decided it

The extant Certificate of Lawfulness establishing a lawful fallback position of six-person HMO use with lower-ground-floor sleeping accommodation meant that refusing permission would not prevent the flood-risk circumstances already capable of arising, making the appeal proposal acceptable on flood-risk grounds.

The benefits of providing acceptable residential accommodation in a sustainable city-centre location, with the fallback position establishing that lower-ground-floor sleeping accommodation could lawfully occur, outweighed the Council's concerns regarding living conditions standards, flood-risk information adequacy, and refuse storage arrangements.
