What decided it
The Secretary of State's conclusion that it had not been demonstrated the development would be safe for its lifetime, causing the flood risk Exception Test under NPPF paragraph 165 to fail.
The very substantial benefits of the scheme (economic, regeneration, biodiversity and heritage benefits) did not clearly outweigh the combined substantial harm from failure to satisfactorily manage flood risk and Green Belt harm from inappropriateness and loss of openness, even though the less-than-substantial heritage harm to Ashton Court Registered Park and Garden was itself outweighed by the public benefits under paragraph 202; overall the balance tipped against the proposal and permission was refused.
