Main issues, as the Inspector framed them

  • Appeal A: whether the Council's decision to refuse to grant a lawful development certificate is well-founded
  • Appeal B: the effect of the proposal on the character and appearance of the host dwelling and the surrounding area taking into account its location within the Ruislip Village Conservation Area

What decided it

Appeal A: The four-year immunity period under section 171B of the 1990 Act was satisfied as the change of use occurred before 27 June 2018 and continued without significant interruption, and the appellant's conduct did not amount to deliberate concealment engaging the Welwyn Hatfield principle. Appeal B: The significant increase in bulk and massing of the crown roof would be visually prominent and would harm the character and appearance of the conservation area, with limited public benefits insufficient to outweigh that harm.
