Main issues, as the Inspector framed them
- Whether the proposed development would comply with the development plan provisions in respect of Houses in Multiple Occupation (HMOs), with particular regard to the potential impacts (including cumulative impacts) of such a use on the provision of an appropriate housing mix, including housing suitable for single-family occupation
- Whether the proposed development would comply with the development plan provisions in respect of Houses in Multiple Occupation (HMOs), with particular regard to the potential impacts (including cumulative impacts) of such a use on neighbouring residential amenity, with particular regard to the effects of noise and other activity-related disturbance
What decided it
The proposal would add to an already high concentration of HMOs in the area (18% of original family housing stock) and would cause unacceptable noise and disturbance to neighbouring residents, conflicting with the development plan and the Framework's aim of creating well-designed, mixed and vibrant communities.
The adverse effects of conflicting with the Framework's aim of meeting evidenced accommodation needs and the harm to amenity substantially outweighed any benefits of approving the scheme, and the scheme did not benefit from the presumption in favour of sustainable development.
