Main issues, as the Inspector framed them

  • whether the condition is necessary and reasonable in the interests of highway safety, with particular regard to the displacement of vehicles from the appeal site

What decided it

A revised condition requiring the submission and approval of a parking layout and management plan would be both necessary and reasonable in the interests of highway safety by securing adequate on-site parking provision and preventing vehicle displacement onto the surrounding highway.

The need to secure adequate on-site parking provision to prevent vehicle displacement and safeguard highway and pedestrian safety was balanced against the operational requirements of the forecourt car sales use, resulting in a substituted condition that requires parking provision to be identified and managed while permitting controlled use of the remaining forecourt area.
