Main issues, as the Inspector framed them

  • the effect of the proposed development on the character and appearance of the area
  • the effect of the proposed development on the living conditions of the occupants of 126a Toms Lane having particular regard to overlooking and whether the development would appear overbearing or visually intrusive
  • whether the proposed development would provide satisfactory living conditions for the future occupants considering whether there would be overlooking between the two dwellings

What decided it

The proposal fails to comply with paragraph 3 of policy DP3 of the Framework by virtue of its backland tandem layout conflicting with policy DM1 of the local development plan, which directs that such development should be refused.

The substantial weight given to housing delivery and self-build provision was substantially outweighed by the conflict with the national decision-making policy DP3 of the Framework, which directs refusal where development fails to respond to its context.
