What decided it
The fact that the appeal premises were already in lawful use as a C4 HMO meant the proposal would not increase the overall percentage of HMOs in the area or cause adverse effects on residential amenity, outweighing the policy conflict.
The conflict with Policy CP21ii) regarding housing mix and balance was outweighed by material considerations including the existing lawful C4 use, the absence of any increase in the proportion of HMOs in the area, and the provision of adequate living conditions for occupiers.
