Main issues, as the Inspector framed them

  • whether the living conditions of the future occupiers of the proposed development would be acceptable, with regard to daylight/sunlight and outlook in the basement
  • the effect of the proposed development on the structural stability of the building, neighbouring buildings and the highway

What decided it

The unacceptable living conditions in the basement, particularly the inadequate daylight, sunlight and poor outlook in the utility room, which could be used as a habitable space, conflicted with the development plan and could not be outweighed by other considerations.

The significant harm to living conditions and resulting conflict with the development plan outweighed the benefits of additional space and design merits, particularly as the proposal would not contribute to housing supply and the council was no longer subject to the presumption in favour of sustainable development.
